By reserving a yacht or using our Service, you accept these Terms. If you do not agree with any portion of the terms, you are not permitted to use the Service.

2. Service Overview

CobaltPaperWing offers luxury yacht charter services, including but not limited to:

  • Yacht rentals on a daily basis
  • Twilight sea voyages
  • Business getaways
  • Exclusive gatherings
  • Extended charters over several days

Our services are subject to both availability and marine conditions. We reserve the right to change or terminate services without prior notice.

3. Booking and Reservations

3.1 Booking Process

When booking a yacht, you must:

  • Be at least 18 years old
  • Supply truthful and complete details
  • Remit the necessary deposit as noted in your booking confirmation
  • Consent to these Terms & Conditions

3.2 Confirmation

A booking is considered confirmed only after we receive your payment and provide a written confirmation. We retain the right to decline service to any individual at our discretion.

3.3 Availability

Charter services are conditional on yacht availability and favorable weather. We’ll strive to accommodate your requested dates and times where feasible.

4. Payment Terms

4.1 Pricing

Our charges are stated in € and cover all relevant taxes unless specified differently. Prices may vary and are subject to modification without prior notice.

4.2 Payment Schedule

  • Deposit: 50% of the full charter cost is due upon reservation
  • Final payment: To be made 48 hours before the charter is set to commence
  • Incidental expenses (if applicable): Payable at the end of the charter

4.3 Payment Methods

We accept major debit/credit cards, wire transfers, and certified bank drafts. We utilize secure, encrypted platforms for processing payments.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

  • Greater than 72 hours before departure: Full refund minus transaction fees
  • Between 24 to 72 hours before departure: 50% of the total is refunded
  • Less than 24 hours before departure: No refund provided

5.2 Weather Cancellations

Should the captain conclude that weather conditions are unsafe, we will propose to:

  • Reschedule the charter to another suitable date at no extra cost
  • Issue a full refund should rescheduling be impractical

5.3 Mechanical Issues

If the assigned yacht experiences technical issues, we will endeavor to supply an adequate substitute. Should that be unattainable, we will refund you in full.

6. Safety and Conduct

6.1 Safety Requirements

All guests are required to:

  • Adhere to all instructions from the crew
  • Don the designated safety gear when asked
  • Declare any health conditions that may affect their safety
  • Stay within the areas of the vessel that are marked as accessible

6.2 Prohibited Items

The following items are strictly forbidden on the vessel:

  • Bottles made of glass
  • Illegal substances
  • Guns or other weaponry
  • Excessive amounts of non-alcoholic drinks
  • Animals (unless they have been pre-approved)

6.3 Conduct

All passengers should behave respectfully. A charter may be aborted prematurely without a refund if the conduct of any passenger represents a danger or ruins the outing for others.

7. Liability and Insurance

7.1 Our Liability

Our accountability is limited to the cost paid for your charter. We are not accountable for:

  • Injuries to individuals that come about due to their own carelessness
  • Loss or damage to personal belongings
  • Indirect or consequential loss, or punitive repercussions
  • Delays caused by the elements or situations beyond our control

7.2 Insurance Coverage

We keep comprehensive maritime insurance for our fleet and operations. Passengers should ensure they have their own travel and personal insurance coverage.

7.3 Assumption of Risk

By taking part in our yachting services, you acknowledge the inherent hazards of marine activities and assume responsibility for your personal safety and security.

8. Modifications and Itinerary Changes

We have the authority to alter itineraries, paths, or timetables due to weather, safety considerations, or operational needs. We will endeavor to provide an equivalent alternative experience whenever possible.

9. Force Majeure

We shall not be held responsible for deferrals, cancellations, or alterations stemming from factors beyond our authority, including but not confined to:

  • Extreme meteorological conditions
  • Catastrophes of nature
  • Legal stipulations
  • Port shutdowns
  • Mechanical breakdowns

10. Privacy and Data Protection
